Welcome to Hobbyhop ("Platform," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access and use of our hobby equipment sharing marketplace, whether as an owner ("Owner"), renter ("Renter"), or buyer/seller ("User"). By using our services, you agree to comply with these Terms. If you do not agree, please do not use the Platform.
1. Eligibility
- You must be at least 18 years old to use the Platform.
- You must provide accurate and up-to-date personal information.
- You agree to comply with applicable Canadian laws and regulations.
2. Platform Services
- The Platform connects Users for renting, buying, and selling hobby equipment.
- We do not own, inspect, or guarantee any equipment listed on the Platform.
- All transactions occur directly between Users; we are not a party to any agreements between them.
3. User Responsibilities
3. 1 Owners
- Must provide accurate descriptions of listed equipment, including its condition and rental/sale terms.
- Are responsible for maintaining equipment in safe, functional condition.
- Must deliver or make available the equipment as agreed with the Renter/Buyer.
3.2 Renters
- Must return rented equipment in the same condition as received, except for normal wear and tear.
- Are liable for any damage, loss, or theft of rented equipment during the rental period.
- Must comply with the agreed rental terms and return deadlines.
3.3 Buyers & Sellers
- Buyers must inspect equipment before purchase.
- Sellers must accurately describe the condition of the equipment.
- The Platform is not responsible for disputes between Buyers and Sellers.
4. Payments & Fees
- Payments are processed through our third-party payment provider.
- The Platform may charge service fees, which will be disclosed at the time of transaction.
- Owners may require security deposits for rentals.
5. Cancellations & Refunds
- Cancellation policies vary by Owner and are specified in each listing.
- Refunds are subject to the Owner’s terms and the Platform’s dispute resolution process.
- If an Owner cancels a confirmed rental, the Platform may facilitate a refund to the Renter.
6. Insurance & Liability
- Owners and Renters are responsible for insuring their own equipment.
- The Platform is not responsible for damages, accidents, or injuries resulting from equipment use.
- Users agree to indemnify and hold the Platform harmless from any claims arising from transactions.
7. Dispute Resolution
- Users should attempt to resolve disputes directly.
- If unresolved, the Platform may offer mediation, but we do not guarantee resolutions.
- Any legal disputes shall be governed by the laws of Canada.
8 Prohibited Conduct
Users may not:
- List illegal or unsafe equipment.
- Use the Platform for fraudulent or unlawful activities.
- Misrepresent equipment conditions.
- Engage in abusive or threatening behavior.
9. Termination
- We reserve the right to suspend or terminate accounts that violate these Terms.
- Users may terminate their accounts at any time.
10. Modifications to Terms
- We may update these Terms at any time, with notice provided through the Platform.
- Continued use after updates constitutes acceptance of the revised Terms.
